Today, Ascent Classical Academy Flatirons lost its second appeal to the State Board of Education on a three to three party-line vote. The Boulder Valley School District’s decision to deny the charter stands. In the first appeal to the SBE, Democratic member Val Flores crossed party lines and voted in favor of the school. It has been said that her vote upset many in the Democratic Party. She was not there today, and her absence disappointed hundreds of families.

The negotiations surrounding the teachers union contract have broken down. Now the situation appears to be getting quite tense in the Boulder Valley School District. Last week I expressed my hopes that the teachers choose to act like professionals, rather than rehash last spring’s “sick out” or even worse. This Daily Camera report (complete with video) from Tuesday’s Boulder Valley School Board meeting indicates the growing possibility that my hopes may not be met: Union officials said they don’t know what value fact-finding would provide, and they’d rather go through the budget to find the money needed to move toward professional pay. Regardless of how negotiations move forward, King has said schools won’t be interrupted. The teachers’ union has said taking some sort of “job action,” such as a strike, is a possibility but they hope to avoid it. [emphases added] Four items to consider:

My friends in the Education Policy Center never quit. They have good new ideas all the time. The latest is the site GoBash (“The Good, The Bad, and The Shameful”): The purpose of the site is to raise public awareness of influential figures who either support or oppose needed reforms of a public education system that has failed thousands of children. The first posting there takes a little different angle on the recent Colorado court victory for parents and charter schools I wrote about last Friday. You lost the suit in district court but appealed to the Colorado Court of Appeals, costing not only the school district but the state more money. Yesterday provided great news for Colorado families who live in school districts unfriendly to certain public education options. The Charter School Institute, a state body created by the legislature in 2004 as another way to authorize charter schools, secured an important legal victory. From a press release in the Attorney General’s office: Colorado Attorney General John Suthers praised a decision by the Colorado Court of Appeals today that upheld the constitutionality of the Colorado Charter Schools Act. The case centers on Boulder Valley School District’s claim that the General Assembly does not have constitutional authority to create and fund charter schools that are not controlled by local school boards.

I know, I know. Yesterday there was this big election, and some things happened that will have an impact on education reform in Colorado. I’m going to let you know more about that a little later. For now, regardless of winners and losers at the ballot box, there are real threats to face – like school officials who won’t give up on using the courts to wrest control and choice from parents: The Charter School Act was passed by the then-Republican controlled General Assembly in 2004 to meet a growing demand for charter schools statewide. The legislation established the Charter School Institute, which provides oversight and funding to state charter schools. Over the last four years, the Boulder Valley School District has consistently tried to tear down the law by challenging its constitutionality. The district says the law takes away its constitutional right to govern schools operating within its boundaries. Provisions in the state constitution allow school districts local control on education policy. This particular complaint was first heard in district court with two other similar cases brought forth by Adams County School District 50 and the Poudre School District.
