LIFO Procedures and Schrödinger’s Financial Crisis
You may have noticed that my policy friend Ross Izard recently published an issue paper calling out nearly half of Colorado’s unionized school districts for maintaining last-in-first-out (LIFO) layoff procedures in their union agreements or negotiated policies. LIFO procedures prioritize seniority over performance when making teacher reduction-in-force (RIF) decisions despite the fact that doing so is both bad policy and against the law. Just this weekend, Ross used a column in the Denver Post to amplify the message that these districts should fix their layoff procedures. He also addressed the weak arguments thrown up by some districts in defense of their remaining LIFO procedures. I encourage you to read both the report and the op-ed if you want to learn more about the issue. For today, I’d like to focus in on one of Ross’s arguments specifically. Vergara Overturned (For Now), But the Conversation Continues
Two weeks ago, I expressed my ambivalence toward the courts (again) while talking about a creative workaround for a Washington Supreme Court decision declaring charter schools unconstitutional. I then mistakenly allowed myself to believe we would be free of legal discussions for a while. No such luck. And this time, stuff’s complicated. Last week, a California Court of Appeals panel overturned the now-famous Vergara v. California ruling. For those who don’t remember, this ruling struck down California’s teacher tenure statute along with other seniority-based policies like the state’s last-in-first-out (LIFO) dismissal policy, which paid no heed to effectiveness. Why? Because the court determined that those policies disproportionately harm low-income and minority students, thereby violating the California Constitution’s requirement that the state provide a “meaningful, basically equal educational opportunity” to all students. A raft of evidence presented by the plaintiffs—a groups of students—and their attorneys showed that seniority-based personnel policies, and especially policies like tenure that make it nearly impossible to let ineffective teachers go, are bad ideas.

Lessons from Boulder Valley: Hoping for No Strike and Even More
The negotiations surrounding the teachers union contract have broken down. Now the situation appears to be getting quite tense in the Boulder Valley School District. Last week I expressed my hopes that the teachers choose to act like professionals, rather than rehash last spring’s “sick out” or even worse. This Daily Camera report (complete with video) from Tuesday’s Boulder Valley School Board meeting indicates the growing possibility that my hopes may not be met: Union officials said they don’t know what value fact-finding would provide, and they’d rather go through the budget to find the money needed to move toward professional pay. Regardless of how negotiations move forward, King has said schools won’t be interrupted. The teachers’ union has said taking some sort of “job action,” such as a strike, is a possibility but they hope to avoid it. [emphases added] Four items to consider:

Why Effective Education Reform Often Is So Hard: Pueblo Edition
Yesterday’s Pueblo Chieftain featured a very telling story of why serious education reform cannot simply be entrusted to the good will of local school bureaucrats. Not that they aren’t necessarily trustworthy, because most of them certainly are. But the prevailing number of federal and state regulations, added on top of the provisions negotiated into the master union contract, have stacked incentives in favor of pleas for more money to help get them out. See what I mean: Local school administrators are well aware of the attempts by districts around the country to find ways to reward teachers and give them incentives to do better but it’s not something that can be done without also finding ways to pay for it. Kathy West, interim superintendent of Pueblo City Schools, said that there are indications that new federal programs will be coming soon to help cash-strapped districts like Pueblo’s do that. But for the time being the district remains with its narrowly worded contract and pay scale that bases salaries on years worked, degrees and training earned and on annual across-the-board pay increases. “It’s just too hard….” In other words, labor peace trumps teacher quality.

A Glimpse at "New" Schools: Montclair School of Academics and Enrichment
Okay, okay … so Denver’s Montclair School of Academics and Enrichment isn’t exactly new. In fact, at more than 100 years of age, it’s one of Colorado’s older public schools. So what’s new about it? Montclair is one of the state’s first two Innovation Schools — as approved by the local school board and by the state board of education under the 2008 state law — and the only school to be recognized both as an Innovation School and as a DPS Beacon School. New Denver KIPP School Performance Pay Plan Latest Charter Innovation
With a variety of programs and greater flexibility from state laws and district policies, public charter schools can provide a great alternative for parents and students looking for something different. Because of that same flexibility, charter schools can serve as great laboratories of innovation for different practices that work. A couple months ago, while school was still in session, my Education Policy Center friends visited KIPP-Sunshine Peak Academy, a charter middle school located in west Denver. The national KIPP network of 82 charter schools has been made famous recently by the book Work Hard Be Nice, written by Washington Post education reporter Jay Mathews.

Well, my friend and Education Policy Center senior fellow Krista Kafer has done it again, joining Dr. Dick Carpenter to co-author another valuable report for the Colorado Department of Education. The brand new report is called The State of Charter Schools in Colorado (PDF). Skim through it, and you’ll see there really is no such thing as an average charter school. Teacher Pay & Tenure System Like Pounding Square Peg into Round Hole
Have you ever tried to pound a square peg into a round hole (or vice versa)? How about after that doesn’t work a couple times, you go out and buy 100 of the same square pegs to keep trying what already failed? It makes about as much sense as most systems we have today for training, developing, paying, and retaining teachers. Sure, we’ve seen some progress with performance pay programs — Colorado has produced some leading examples — but the old-fashioned salary schedule still persists. Pay teachers based on seniority and academic credentials. Never mind, as the Denver Post‘s Jeremy Meyer observes from Urban Institute education director Jane Hannaway (with supporting evidence compiled here), that teachers overwhelmingly improve during the first four years of their career and then just stop: “It’s one of our very consistent findings,” said Hannaway, presenter last week at the American Educational Research Association annual meeting in San Diego, citing at least two recent studies of teacher effectiveness. “The reason of course is not clear, but it’s in study after study,” she said. “Teachers do get better (in the beginning). The Real World Would Recognize (and Deal with) Both Good and Bad Teaching
Every child is always a winner … Children just need better self-esteem … We only need to use positive incentives to help children learn more … Let’s reward the good but pretend like the bad doesn’t exist … I’m only 5 years old, and I get that this is marshmallow world nonsense. In fact, it’s the kind of silliness that makes many people question (sometimes fairly, sometimes not) the value of much of what goes on in public education. It gets even worse when the principle is applied not only to students, but also to teachers. At least if the union has its way. Witness the evidence from Chicago, a city with many failing schools: principal evaluations found only 3 out of every 1,000 teachers had unsatisfactory performance. While unions thrive on fears of bogeyman administrators who take out their vindictiveness on good teachers they don’t like, this evidence at least indicates the problem tips in the other direction. In any case, wouldn’t a more objective data system be better?

Colorado Charter-Friendliness Gets a B, As 41,000 Students Wait to Get In
I don’t know about you, but some parents give their kids money for getting certain grades on a report card. Not mine (at least they tell me they’re not going to), but that’s a different story. If Colorado were getting money based on how well it treated charter schools, how would it do? The Center for Education Reform‘s new report Accountability Lies at the Heart of Charter School Success says Colorado’s charter school law merits a B. Only eight states do better. Further, though our state’s charters receive significantly less funding than their other public school counterparts, their overall performance is commendable: In 2007, 74 percent of charters made federal accountability targets of Adequate Yearly Progress (AYP) while only 59 percent of conventional public schools did the same. Charter middle schools in Colorado are making the grade as well. In 2006, 55 percent of middle school charters were rated excellent or high by the state Department of Education, compared with 41 percent of conventional public middle schools.
