LIFO Procedures and Schrödinger’s Financial Crisis
You may have noticed that my policy friend Ross Izard recently published an issue paper calling out nearly half of Colorado’s unionized school districts for maintaining last-in-first-out (LIFO) layoff procedures in their union agreements or negotiated policies. LIFO procedures prioritize seniority over performance when making teacher reduction-in-force (RIF) decisions despite the fact that doing so is both bad policy and against the law. Just this weekend, Ross used a column in the Denver Post to amplify the message that these districts should fix their layoff procedures. He also addressed the weak arguments thrown up by some districts in defense of their remaining LIFO procedures. I encourage you to read both the report and the op-ed if you want to learn more about the issue. For today, I’d like to focus in on one of Ross’s arguments specifically. Thompson Majority Fights On for Local Control
Most of you probably remember that there’s sort of a thing going on in Thompson School District. Okay, maybe that’s a bit of an understatement. In actuality, Thompson now stands alongside Jefferson County as ground zero for one of the most important education battles in Colorado. More specifically, Thompson has been engaged in an ugly fight with the Thompson Education Association, backed heavily by legal support from the Colorado Education Association, over the reform-minded board majority’s decision not to accept two junky tentative collective bargaining agreements. At the center of that fight is an incredibly important question: Can locally elected school boards be forced to accept union contracts with which they disagree? The issue has drawn significant attention from around the state, including an editorial from the Denver Post supporting local school boards’ ability to make judgment calls under Colorado law. It has also resulted in a flabbergastingly awful non-binding arbitration report and, more recently, an unprecedented injunction ruling that forces the district to abide by the 2014-15 collective bargaining agreement—an agreement that the board has rejected in one form or another three separate times. Jeffco Leads the Way on Sensible Union Contract Changes
I’ve got to be honest, the Denver Post’s Editorial Board has kind of been knocking my socks off recently. First, they wrote good, thoughtful columns on the Dougco voucher decision and the abuse of democracy that is the Jeffco recall. Now they’ve come out with a new column praising Jefferson County School District’s new tentative tentative agreement with the Jefferson County Education Association. No, the second “tentative” is not a typo. As exciting as this new contract is, it still needs to be ratified by JCEA’s more than 3,000 members. That said, I join the Denver Post in praising Jeffco adults’ newfound ability to “gather their senses,” and I sincerely hope cooler heads will prevail when it comes to contract ratification among union members. While we wait for the results of the union ratification vote scheduled for August 21, it’s helpful to take a look at why this agreement is such a big deal. From my edu-wonk perspective, it accomplishes some very important things: Prioritizes teacher performance in cases of layoffs or displacements instead of basing these decisions solely on seniority. Thompson Stands Up for Change
Some famous guy at some point in history once said that the hardest part of any effort is taking the first step. How right he was. Even at the tender age of five, I can tell you that it’s hard to do big, scary, important stuff. But you don’t need to take my word for it. Just ask the Thompson Board of Education! Reform-minded members of Thompson’s school board took a really big first step last night when they shot down the tentative agreement coming out of the district’s months-long union negotiation process. You probably remember our discussion of that agreement a couple of weeks ago. If not, this piece by my friend Ross Izard should catch you up. The short version is this: The “new” contract stunk. Faced with the prospect of having to sign the aforementioned stinky contract, Thompson’s reformers took a brave stand and refused to act as a rubber stamp for the union or district bureaucrats. The board members did a great job of articulating their points, and they made a whole lot of good sense to me.

How Not to Negotiate: Thompson's Tepid Tentative Agreement
Last week, we dove into the ongoing ugliness in Thompson School District. The highlight of that post was CEA’s bogus petition against the board majority’s attempts to draft clearer MOU for negotiation. Certainly, CEA’s involvement in the district is a major issue and seriously alters the calculus as negotiations move forward. Reform board members were escorted to their cars by police after a recent meeting. The president of the Thompson Education Association (TEA) responded by saying that although he encourages union members to be professional, “passions will be passions.” Nice. So yeah, that’s a little concerning. Yet maybe the union isn’t the only thing reformers in Thompson have to worry about. The district’s own bureaucrats may be serious obstacles themselves. My education policy friend Ross Izard published a new column today about the tentative agreement that has emerged from the district’s negotiations with the local union, the Thompson Education Association. The tentative agreement is… far from promising. And that’s putting it kindly.

If You Want Something Done Right: CEA Steps into Thompson's Union Negotiations
After observing many of them on the playground, I can say that bullies are interesting creatures. Usually, they figure they can just push you around without any resistance. But stand up to them just a little, and they have to reevaluate. That reevaluation usually involves a two-step process. First, they try out nasty underhanded tactics like those used by the Jefferson County Mean Girlz. If that doesn’t work, or they meet more resistance (as the Mean Girlz certainly did), they often run off to find bigger, meaner friends to back them up. It appears that the Thompson Education Association has been paying attention to the Jeffco edu-blob’s failures on step one of the bullying handbook. The district’s union and its supporters have skipped straight to step two and called in reinforcements from the Colorado Education Association, our state’s powerful and extremely political teachers union.

Lessons from Boulder Valley: Hoping for No Strike and Even More
The negotiations surrounding the teachers union contract have broken down. Now the situation appears to be getting quite tense in the Boulder Valley School District. Last week I expressed my hopes that the teachers choose to act like professionals, rather than rehash last spring’s “sick out” or even worse. This Daily Camera report (complete with video) from Tuesday’s Boulder Valley School Board meeting indicates the growing possibility that my hopes may not be met: Union officials said they don’t know what value fact-finding would provide, and they’d rather go through the budget to find the money needed to move toward professional pay. Regardless of how negotiations move forward, King has said schools won’t be interrupted. The teachers’ union has said taking some sort of “job action,” such as a strike, is a possibility but they hope to avoid it. [emphases added] Four items to consider:
